Terms of Service & Privacy Policy

SMS & Authentication Notice: When you provide your mobile number, you consent to receive one-time passcodes (OTP) via SMS solely for authentication and platform security. Message and data rates may apply. Reply STOP to opt-out or HELP for assistance. Interview Passport does not send promotional SMS marketing.

1. Agreement Binding, Legal Entity & Data Controller

Interview Passport and its hiring portal (hire.interviewpassport.ai) are owned and operated by Interview Passport Ltd ("Company", "we", "us", "our"), a company registered in England and Wales. For the purposes of the UK Data Protection Act 2018 and UK GDPR, Interview Passport Ltd acts as the statutory Data Controller.

Binding Acceptance: By accessing, browsing, registering on, or utilizing any website, API, dashboard, or service provided by Interview Passport Ltd in any monetary or non-monetary capacity, you unconditionally agree to these Terms of Service & Privacy Policy. This applies equally to Candidates, domain Experts/Interviewers, and Hirers/Recruiters. If you do not agree, you must immediately cease using the platform.

2. Payment Terms & Strict Non-Refundability Policy

All financial transactions executed through Interview Passport Ltd or hire.interviewpassport.ai are subject to the following binding terms:

  • Payments by Hirers & Candidates: All session purchases, recruiter credits, platform access subscriptions, and candidate bookings made to Interview Passport Ltd are 100% final and strictly non-refundable under any circumstance (including candidate no-shows, interview cancellations, unsatisfactory scores, or failure to hire).
  • Payments to Experts: Remuneration payable by Interview Passport Ltd to Experts for technical evaluations is contingent upon complete adherence to session standards. Payouts may be forfeited or withheld for incomplete evaluation reports, missed sessions, suspected cheating collusions, or breaches of terms.
  • Reversals & Chargebacks: Any fraudulent chargeback or billing dispute initiated against Interview Passport Ltd will result in immediate termination of all associated accounts, permanent invalidation of candidate passports, and potential legal action under UK law.

3. Tri-Party Conduct Release & Liability Disclaimer

Interview Passport Ltd serves strictly as a neutral digital platform. We do not employ Experts, nor do we act as an employment agency for Hirers or Candidates.

  • Tri-Party Release (Hirers, Candidates & Experts): You hereby release and forever hold harmless Interview Passport Ltd, its officers, directors, and agents from any and all past, present, or future claims, actions, damages, or disputes arising between or among Candidates, Experts, and Hirers.
  • Interpersonal Misconduct & Harassment: Interview Passport Ltd disclaims all liability for off-platform contact, stalking, harassment, defamation, discrimination, or personal misconduct committed by any Candidate, Expert, or Hirer.
  • Subjective Assessment & Hiring Decisions: Evaluation reports and scores reflect independent, subjective Expert opinions and automated AI data. Interview Passport Ltd bears zero liability for rejected employment applications, unfavorable interview feedback, or hiring decisions executed by Hirers.

4. Limitation of Liability & General Release

General Indemnification: To the maximum extent permitted under applicable law, you agree to defend, indemnify, and hold harmless Interview Passport Ltd against any and all losses, claims, liabilities, costs, legal fees, or damages arising out of or related to your access, monetary transactions, non-monetary usage, candidate assessments, or violation of these Terms.

Maximum Financial Cap: Under no circumstances shall Interview Passport Ltd be liable for any indirect, incidental, consequential, or loss-of-profit damages. In all events, the total cumulative liability of Interview Passport Ltd for any legal claim shall not exceed the lesser of **£100 GBP** or the total amount paid by you to the Company in the twelve (12) months preceding the claim.

5. Non-Circumvention & Privacy Protection

To maintain assessment integrity and user safety:

  • Prohibition of Direct Contact: Candidates, Experts, and Hirers are strictly prohibited from soliciting, contacting, or bypassing the platform to arrange direct technical evaluations or hiring engagements outside our ecosystem.
  • Data Masking: Contact details are redacted across all evaluation interfaces to protect user privacy and prevent harassment or circumvented bookings.

6. Data We Collect & UK GDPR Compliance

We process personal data necessary to provide assessment badges, prevent fraud, and manage public credentials:

  • Account Data: Name, professional title, email address, mobile number, profile photo, and login details.
  • Evaluation Data: CVs, video recordings, audio transcripts, scorecards, and AI analysis reports.
  • Technical Data: IP addresses, browser specs, device markers, and network audit logs.
  • Billing Metadata: Transaction reference IDs, invoice metrics, and payout logs (card numbers are managed directly by PCI-compliant payment gateways).

7. Lawful Bases for Processing

Data processing relies on statutory justifications under UK GDPR:

  • Contract Performance: Essential processing to host interview sessions and issue candidate passport reports.
  • Legitimate Interests: Preventing off-platform circumvention, protecting network integrity, and fraud mitigation.
  • Legal Obligation: UK corporate tax compliance and statutory accounting rules.
  • Consent: Explicit authorization for SMS OTP security passcodes or toggling passport visibility to "Public."

8. International Data Transfers & Statutory UK GDPR Data Rights

International Transfers: As a UK entity, we may transmit encrypted records to secure cloud infrastructure outside the UK or EEA (including the US and India). Transfers strictly comply with UK GDPR using Standard Contractual Clauses (SCCs) and the UK International Data Transfer Agreement (IDTA).

Users located in the UK/EEA hold statutory rights regarding personal data:

  • Access & Portability: Obtain copies of personal data or machine-readable passport exports.
  • Rectification & Erasure: Request corrections or data erasure (subject to mandatory legal financial retention requirements).
  • Restriction & Objection: Object to processing under legitimate interest claims.

9. Governing Law & Legal Jurisdiction

These Terms, along with any non-contractual disputes arising from the use of Interview Passport Ltd, are strictly governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales hold exclusive jurisdiction.
